Terms and Conditions for [Bizz Feed]

Please read these Terms and Conditions carefully before using the [Bizz Feed] mobile application (the "Service") operated by [Cmolds]. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users, sub-admins (company owners), and super admins who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Definitions

• Service refers to the [Bizz Feed] mobile application, available on iOS and Android platforms, which provides poll creation, voting, and suggestions functionality.
• User refers to employees of companies using the mobile application, who are eligible to vote in polls and make suggestions, engage with news feeds and report incidents.
• Sub-Admin refers to the company owner or administrator who creates and manages polls and suggestions for their employees.
• Super Admin refers to the individual or entity that manages and oversees all activities within the application, including default stock polls and user/sub-admin management.

2. Acceptance of Terms

By accessing or using the Service, you accept and agree to these Terms and any amendments or updates that we may make from time to time. You must read these Terms before accessing or using the Service, as they affect your legal rights and obligations.

3. Eligibility

You must be 18 years or older and capable of entering into a legally binding contract under the laws of the United Kingdom to use this Service. By using the Service, you represent and warrant that you meet this requirement.

4. User Responsibilities

As a User of the Service, you agree to:

• Participate in polls and make suggestions as part of your company's engagement.
• Respect the anonymity of the suggestions made by other employees and refrain from any action that violates the privacy of other users.
• Not misuse the voting, suggestion, or reaction features to spread malicious content or cause harm to others.
• Use the Service only for lawful purposes and in accordance with these Terms and applicable laws.

5. Poll Creation and Voting

• Sub-Admins are responsible for creating polls within their company using either custom polls or stock polls provided by the Super Admin.
• Polls may contain text and images and will expire after a specified time, after which results will be displayed in a visual graph format.
• Poll results are viewable by the Sub-Admin and the Super Admin.
• Sub-Admins may choose to share poll results publicly or privately, but this option is only available for stock polls.

6. Suggestions Box and Employee Reactions

• Users can submit suggestions anonymously in the suggestion box.
• Other employees can react to suggestions using two reactions: "Interested" or "Not Interested."
• Users can view the history of polls they have voted on in the "My History" section.

7. Privacy and Data Protection

We are committed to protecting the privacy of our users. All personal data collected through the Service will be handled in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR), applicable to users in the United Kingdom.

Your information, including but not limited to your voting history and suggestions, will be stored and processed on secure servers hosted by Azure Web Apps, and will not be shared with third parties except as required by law or as part of the operation of the Service.

8. Sub-Admin and Super Admin Rights and Responsibilities

• Sub-Admins are responsible for managing polls, suggestions, and employee interactions within their company.
• Super Admins have the authority to manage users, sub-admins, and content across the platform.
• Super Admins may also provide stock polls that Sub-Admins can post, and are responsible for managing static content, app feedback, and overall platform security.

9. Content Ownership and Licensing

All content, including polls, suggestions, and images uploaded to the Service, remains the property of the User or Sub-Admin who uploaded it. By submitting content through the Service, you grant us a worldwide, royalty-free, and non-exclusive license to host, distribute, and display this content as part of the functionality of the Service.

10. Restrictions on Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Engage in any conduct that violates the privacy, rights, or security of other users.
• Reverse engineer, decompile, or modify any part of the Service.
• Use automated systems to scrape or collect information from the Service.

11. Intellectual Property Rights

All intellectual property rights in the Service, including but not limited to software, design, text, graphics, and logos, are owned by or licensed to BizzFeed Limited and are protected by copyright, trademark, and other applicable laws.

12. Termination

We reserve the right to terminate or suspend access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or contact us at customerservice@bizzfeed.net.

13. Limitation of Liability

To the maximum extent permitted by law, BizzFeed Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or any damages arising from your use of the Service or inability to use the Service.

14. Indemnification

You agree to indemnify and hold harmless BizzFeed Limited its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights, including intellectual property rights.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

16. Changes to Terms and Conditions

We reserve the right to modify or replace these Terms at any time. Any changes will be effective immediately upon posting. You are responsible for regularly reviewing these Terms. Your continued use of the Service after any changes have been made will constitute your acceptance of the updated Terms.
